HARRISBURG, Pa. -- The new judge overseeing the long-delayed criminal proceedings against three former high-ranking Penn State administrators heard arguments Thursday about whether the remaining charges should be thrown out.The hearing in Harrisburg before Judge John Boccabella could be the prelude to trial or lead to the dismissal of charges in the case that began almost five years ago. Boccabella didnt indicate when he will rule but did drop a perjury charge against former athletic director Tim Curley. All three defendants were in court: Curley, who is now retired; the schools former president Graham Spanier, still a faculty member; and former vice president Gary Schultz, retired. They are accused of not responding properly to a 2001 complaint by an assistant coach that Jerry Sandusky was sexually abusing a boy in a team shower and also are accused of putting children in danger.Sandusky, a retired longtime defensive coach at Penn State, was convicted of 45 counts of child sexual abuse in 2012 and is serving a 30- to 60-year prison sentence. His case is on appeal. Some of whats at issue in the administrators criminal case:Contact with childrenDefense lawyers argued that the allegations require the defendants to have been actively supervising the welfare of children but that their job duties did not include that responsibility. They also noted that the language of state law in 2001, when the incidents occurred that led to the current charges, required people to report suspected abuse if they regularly came in contact with children and had reasonable cause to think a child coming before them had been abused.Deputy Attorney General Patrick Schulte said a recent court decision in a high-profile clergy abuse case means the issue is not direct supervision of children but supervision of child welfare. The Penn State athletic facilities turned into the breeding ground for Jerry Sanduskys child exploitation and child molestation, Schulte told the judge. He said laws designed to protect children have to be interpreted broadly and that emails among the defendants are evidence they did more than stay silent -- that they decided not to act on the report about Sandusky in a team shower.Conspiracy countThe attorney generals office is seeking to add a new count, of conspiracy to commit endangering the welfare of children, against all three defendants. In a set of motions filed Wednesday, prosecutors said they were making the request because of a Superior Court decision in June that threw out conspiracy charges and other offenses linked to them. The court filings say endangering the welfare of children wasnt thrown out, so its related conspiracy charge should be permitted. There was no discussion of the motions during the court proceeding. Boccabella said he would deal with that issue at some later time.Statute of limitationsThe defendants believe the two-year statute of limitations has expired for crimes that allegedly occurred 15 years ago, but prosecutors counter with a claim the men engaged in continuing conduct so the time limits should not apply.Curley lawyer Caroline Roberto told the judge that the case, given the passage of time, shows why the statutes of limitations are treated as sacrosanct in the criminal justice system.Chief Deputy Attorney General Laura Ann Ditka said the defendants were aware of what they were doing by not reporting Sandusky. They made a choice, and each and every day they engaged in conduct that furthered that choice, Ditka said.Change of venueSpanier attorney Bruce Merenstein said previous charges involved a grand jury that met in Harrisburg, but Superior Court threw them out.He suggested that now it would make more sense to hold the trial in Centre County, near the Penn State campus.Boccabella said he is not sure theres a better location for the trial than Harrisburg. The Associated Press contributed to this report. Lannan tossed four-hit ball over eight innings against his former team, Ben Revere had three hits and the Philadelphia Phillies beat the Washington Nationals 3-2 Monday night. Lannan (2-3) had four strikeouts in his longest outing in four years. The lefty registered 12 groundouts to beat the team he played for his first six seasons in the majors. "At this point, Im looking for consistency," he said. "It doesnt matter who Im facing. I have to put up zeroes. Thats what I have to do, keep the ball on the ground. Im not a strikeout guy." Jonathan Papelbon allowed two runs in a shaky ninth to earn his 19th save in 23 tries. Dan Haren (4-10) came off the disabled list and took the loss after missing two weeks because of right shoulder inflammation. Haren allowed two runs and seven hits in five innings, striking out a season-high seven. "I think the time off helped me to clear my head," said Haren, who is 0-7 with a 6.66 ERA in his last nine starts. Revere and Jimmy Rollins, the 1-2 hitters in Philadelphias lineup were 5 for 9 with three runs and one RBI. The Phillies opened an important four-game set against second-place Washington with their fifth win in seven games. They won consecutive series against first-place clubs, taking two of three from Pittsburgh and Atlanta. "We got to keep playing, stay with it, manager Charlie Manuel said. While Lannan downplayed beating his ex-teammates, Manuel figured his pitcher was fired up. "I think its kind of natural," Manuel said. "I know I would be. I might be jumping up and down." The Nationals had won four in a row. Bryce Harper, chosen earlier in the day to participate in the Home Run Derby next week, led off the ninth with his second hit. After Ryan Zimmerman hit a double, Jayson Werth hit a sacrifice fly. Adam LaRoches sac fly cut it to 3-2 before Papelbon retired pinch-hitter Chad Tracy to end it. Tracy hhit a tying homer off Papelbon in the ninth inning on June 17, but the Phillies rallied to win that one.dddddddddddd "We made a nice comeback against one of the best closers in the league," Nats shortstop Ian Desmond said. Making his first start since June 22, Haren struggled in the first. Revere and Rollins started Philadelphias first with consecutive singles followed by a double steal. After Chase Utley struck out, Domonic Brown drove in a run with a single off Harens leg. A bases-loaded walk to Darin Ruf forced in the second run. "We just have to continue to do the little things, especially with Ryan out of the lineup," Brown said. "We got guys with speed on base, making things happen." It stayed 2-0 until the sixth. Revere hit a two-out double and scored on Rollins line-drive single to right. Revere slid in safely ahead of Jayson Werths strong throw and nearly kicked Utley in the face doing a backward kick-stand getting up after the slide. Revere has raised his average to .300 from .200 on May 1. "I feel a lot more comfortable at the plate," Revere said.
