Kelvin Gastelum has avoided suspension in the state of New York, the New York State Athletic Commission has now confirmed.The UFC fighters camp told ESPN.com on Tuesday he has agreed to pay a fine in lieu of any suspension. According to the NYSAC, the settlement was a fine of $2,000.This development clears the way for Gastelum (12-2) to face middleweight Tim Kennedy (18-5) at UFC 206 on Dec. 10 in Toronto. The Ontario Athletic Commission still needs to license Gastelum, but no suspension will stand in the way of that.Gastelum, 25, was facing a six-month suspension for failing to appear at a weigh-in on Nov. 11.He was scheduled to fight Donald Cerrone in a welterweight bout at UFC 205, but the fight was canceled due to Gastelums inability to make weight.The NYSAC automatically suspends mixed martial artists for missing weight -- which is unique among U.S. athletic commissions. Lightweight Thiago Alves received a three-month suspension for missing weight, although his fight against Jim Miller went on as a catchweight.Gastelum has a history of struggling to make the 171-pound welterweight limit. So he took an assistant teaching position in New Mexico before joining the Army not so much as a path to Olympics -- he didnt know about WCAP -- but simply because, I wanted to be American, he said.Later, his two older brothers followed his lead -- Julius joining him at Fort Carson and Emmanuel at Fort Bliss, Texas.Bors running career was rekindled through a timed two-mile run thats required for soldiers.He finished in roughly 10 minutes.Everyone was like, `You should compete for the Army team, Bor said.Not as simple as that, though. First, he had to earn his place in WCAP by running a qualifying time. It took him nearly three years -- and stepping up his training largely on his own -- to earn inclusion.A typical day for him went like this: Rise at dawn for training runs with an off-base coach, return to perform his Army tasks and train again at night.In May, Bor ran the necessary time to earn a spot in WCAP. And in July, he finished second at trials to secure his place in Rio.Fittingly, Bors first message was to his brother in Afghanistan.This is not only for my brother, but for my whole unit, Bor said.
